These Terms & Conditions govern the relationship between you and Nikolai Iakubovskii (Calle Emilio Tuya, 37, Gijon, Asturias, 33202, Spain) regarding use of the Benzio mobile application, website, and related services (the "Service").
Users must be at least 13 years old. Those aged 13–16 in the EU require parental consent. By using the Service, you agree to these Terms and the Privacy Policy.
1. License
1.1 Grant of a Limited License
We grant you a non-exclusive, non-transferable, non-sublicensable, revocable limited license to use the Service for personal, non-commercial purposes only.
Restrictions include:
- No accounts for those under 13
- No purchasing, selling, or transferring accounts
- No false identity accounts
- Non-commercial use only
1.2 License Limitations
You agree not to:
- Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software
- Modify Service files without written consent
- Disrupt servers supporting the Service
- Attempt unauthorized access to any part of the Service
- Post abusive or offensive content
- Reverse engineer or decompile the Service
1.3 Suspension and Termination
We may suspend or terminate accounts for non-compliance or improper use. Inactive accounts may be terminated after 180 days, with 30-day advance notice via email.
2. Ownership
All rights to the Service belong to the operator. You have no ownership interest in your account. All content, data, graphics, and other materials that appear in the Service are owned by the operator.
3. User Content
You are responsible for any content you submit through the Service. By submitting content, you grant us a worldwide, royalty-free license for operational and improvement purposes. This license ends upon content deletion unless shared with other users.
We may remove content that violates these Terms or receives multiple reports.
4. Subscriptions and In-App Purchases
4.1 Premium Subscription
Benzio Premium offers the following plans:
- Weekly (auto-renewing every 7 days)
- Monthly (auto-renewing monthly)
- Yearly (auto-renewing annually)
Regional pricing varies; all prices include applicable taxes.
4.2 Auto-Renewal
Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. Charges occur within 24 hours of renewal.
4.3 Cancellation
You can cancel through your device settings:
- iOS: Settings → Apple ID → Subscriptions → Benzio
- Android: Google Play Store → Subscriptions → Benzio
Cancellation takes effect at the end of the current period; premium access continues through the remainder of the paid period.
4.4 Refunds
All purchases are processed by Apple or Google. Refund requests should be directed to the respective app store. We do not handle refunds directly.
4.5 EU Right of Withdrawal
EU consumers have a 14-day withdrawal right for digital purchases. However, by making a purchase and beginning to use the digital content, you expressly consent to the immediate performance of the contract and acknowledge forfeiting withdrawal rights once content delivery begins.
5. Fuel Price Data Disclaimer
The Service displays fuel prices sourced from publicly available government APIs and official data sources. Prices shown are approximations and may not reflect the exact price at the pump at any given moment. Benzio is an informational tool only and does not guarantee the accuracy, completeness, or timeliness of any fuel price data displayed.
6. Updates to the Service
We may update the Service with or without notice and may require you to update to the latest version for continued access.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. Some jurisdictions prohibit certain warranty exclusions; in such cases, the above may not apply to you.
8. Limitation of Liability
To the maximum extent permitted by law, the operator bears no liability for indirect, incidental, consequential, special, or punitive damages, including loss of data or profits.
Nothing in these Terms shall affect the statutory rights of any consumer, or exclude or restrict any liability resulting from gross negligence, willful misconduct, or fraud, or any liability that cannot be excluded under applicable law.
9. Governing Law and Dispute Resolution
These Terms are governed by Spanish law. Disputes are subject to the courts of Gijon, Asturias. EU consumers may bring proceedings in their home country or use the European Commission's Online Dispute Resolution platform.
10. Changes to These Terms
We may modify these Terms at any time. Material changes require 30-day advance notice via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
11. Severability
If any provision of these Terms becomes unenforceable, it becomes ineffective without affecting the remaining provisions.
12. General Provisions
- Assignment: We may assign these Terms at any time; you cannot without written consent.
- Entire Agreement: These Terms and the Privacy Policy form the complete agreement.
- No Waiver: Non-enforcement of any provision does not waive it.
- Notices: Communications occur via app, email, or website postings.
- Force Majeure: We are not liable for delays caused by events beyond our reasonable control.
